Private Sale - Sole Agency
My house is currently on the market with an agent under sole agency. We are 4/5 weeks into the agreement, in that period they have sent around 5 people of which 2 were not interested and 1 are coming back to view again but have a proeprty to sell. In the meantime a friend has pulled out of another house purchase and want to buy ours. Was wondering where I stand with regards to fees we still have 10 weeks to run on the agreement but can give the agent 2 weeks notice it dosent refer to "sole selling agent" anywhere so if I took the house off of the open market with a cooling off period of two weeks would I be able to sell to my friend agent free and not pay any commission?

Personally I would inform the agent I was no longer selling and ask that they stop marketing your property. As it’s a friend purchasing, they have not utilised the agents services or marketing so the agent is not entitled to any fees.

You need to check your terms of business carefully. Under what circumstances are they entitled to a fee? Probably only if they introduce someone to your property. If this is the case, proceed with your friend's offer and give your agent two weeks notice. Be honest as they will probably want to continue viewings in case something changes with your friend but ultimately you don't have to sell to a buyer they introduce anyway.
