Buy house with seller stuck there?

Supposing I buy a house and there's a chain, and the seller can't yet move out, how long must elapse before the seller is legally required to leave the property?..Am I entitled to evict them if they still don't leave after this time?

  • Before you exchange contracts on a sale all parties must agree to move on a certain date. If you exchange and money moves and you own the property, legally the seller no longer owns the property and must vacate, if they don't you have to take steps to evict.

  • If you exchange contracts you are entitled to charge the defaulting party interest as stipulated in the contract. If they do not move you can apply for an order of specific performance to enforce the execution of the contract. It shouldnt come to that though.
