Extension without Building Approval/unregisted title/right of way

We are in the process of buying a property which showed a Right of Way which was purchased in the Covenants in 1977 and then in 1980 an extension was built to add a bedroom which is located on part of this said Right of Way. Also the Extension does not have planning or building regulations approval when it was built in the 1980 and we are concerned that if we buy the property (cash purchase) that we may find it difficult to sale on at a later time. Can anyone help with our questions? Thanks

  • If the right of way is sorted, then there should be no issue with planning as the extension is more than 10 years old. Building regs, I believe as long as it was upto to standards for the time of construction, you should be fine a s well. Speak to your socilitor about the right of way and pop up to the local council and speak to a planning officer. take lots of pics Christopher
