Didn't sign an estate agents agreement form

An agent is marketing my property on a sole agency basis, i agreed an 8 weeks period. It mentions in the agreement that you can terminate the agreement by giving 28 days notice - is this only relevant within the 8 week period? Once the 8 weeks elapses, am I free to use another agent? Also, whilst the property is being marketed, i didn't actually sign the agreement, so technically is there actually any agreement in place?

  • . The answer is yes there is an agreement in place; it is just good practice and undisputable to have signed terms but by allowing the agent to market the property you have agreed to the terms. The law states that you must have seen the terms in writing prior to the commencement of marketing. Typically to finish the agreement you must serve 28 days written notice, this is the complicated bit. In the agreement is it written that the term will be for a minimum of 8 weeks after which it can be cancelled by serving 28 days written notice ( In effect a 12 week agreement). Or is it that you can serve 28 days to cancel the agreement at week 4 to end at week 8, or it could be written that the period of agency is 8 weeks only (which I doubt) then you will not have to serve notice. It would be best to speak to the agent in question and just ask them how long and when can you serve notice. Should you wish to change to an alternative agent I can recommend an independently assessed best in area agent for you. Good luck in your move

  • I have to dispute what the previous pesron has posted! If you have not signed any agreement then you are not liable in anyway shape or form! If you are unhappy with with what the current agent is doing I would love to have a chat with you about what we can do for you!
