Stamp Duty, is it payable?
If someone has not owned a house in UK for the last 36 years, do they qualify as a first home owner?

Anybody who has had their name on title deeds of a property in this country or another would have to pay the stamp duty regardless of how long they have been living abroad. If they are a FTB and have never owned a property anywhere then they are entitled not to pay the stamp duty.

Your solicitor is required to get you to sign a declaration that you have never owned a property before, if you have owned a property even briefly many years asgo then you will still have to pay the stamp duty.
