When you bought the property the boundaries would have been marked and responsibility for who repairs which side would be on there. If you are not sure or call the solicitor you dealt with and they should be able to look it up.

You can usually get a clue by looking at the fence. The person who has paid for the fence usually has the smooth facing panels on their side, and puts the back of the panels and fence posts facing the neighbour`s garden.

You can download yours and your neighbour’s deeds for £4 each online. You need to look at your deeds/covenant wording. It is an old convention that the fence owner gives the smooth side to the neighbour, it is not law. The fence owner gets to choose which side they want, unless the fence is shared. A shared fence means some compromise needs to be made. It is always advisable to come to a mutual decision with your neighbour if the fence is shared.
