Access issue when viewing a property?

I went to view a property, and the owner of the property opposite was really nasty and said he owned all the road and that we could not gain access to view the property as he had put up lots of private road signs. The property has been greatly reduced and I wonder how I can find out if he really owns the road and can stop access to this property?

  • You would need to contact the land registry to find out who owns the road, although I would advise to walk away from a property with a neighbour who won't let a visitor to the neighbouring property use the road.

  • You should speak to the owner of the property being sold about any positive easements regarding access. Even if the person does own the road, there is likely to be something in place whereby he has to allow access to the other properties. The owner may be best seeking legal advice though.

  • Hi, The estate agent selling the property can advise you whether or not the property has been adopted. I.e. public. or they will be able to advise you whether or not it is private and therefore from there you will be able to see your rights of access to the property.
