Holding Deposit help! Flat back on the market?

Hello, Me, my boyfriend and our friend have found the perfect flat and paid a holding deposit on Friday 22nd. We signed our forms detailing our income, details, past accommodation, etc. and handed that all in the next day (Saturday 23rd). On Monday 25th they sent my friend and I guarantor forms to fill out as we are both students. I filled mine out the next day but she still hasn't had hers filled out because her parents were busy. The property online had said that it was no longer on the market for the past few days and on Wednesday morning it had been taken off the website completely. However as of Wednesday night it no longer says that it is off the market, it is back up on the website. It has only been 7 days, should I be worried that the holding deposit is no longer valid? I sent an email apologising for the delay and saying we are still interested and would hopefully be in to drop off forms today but I am still worried. Thanks, Rebecca.

  • Hi beccaco, A holding deposit indicates good faith and intent on your part, but they are typically non refundable. It may be a mistake on the part of the agent and the letting shouldn't have been re-uploaded, but your best course of action is to discuss the situation with your agent or the landlord. Check to see if there's a holding deposit agreement, this may make it clearer. Unless someone hasn't acted in good faith, there should be no reason that your agreement has changed.
