My deposit was registered in Feb 2008 but my tenancy started in Nov 2005. Is this legal?

When your tenancy started in November 2005, there were no regulations in place requiring a landlord or agent to lodge a deposit with an approved deposit scheme. If your landlord or agent decided to lodge the deposit in 2008, this was nothing more than very good practice on their part, and does in fact give you more security at the end of your tenancy, should their be a dispute over the deposit. I would say that you are in a far better situation now.
