No contract with estate agent

We put our house on the Market with an agent a year ago and they never got us to sign a contract. We then put it on with another agent and asked them to remove it. After about a year they said they had some one to look at it and the people have now bought it for 525k We have no contract with the agent stating rates etc, where do we stand and do we have to pay them?

  • You will have to pay them unless you want to go to court! The fact of the matter is they will be able to prove that they found you the buyers! Of course if somehow (very unlikely) they have forgotten then your luck might be in!

  • Let them take you to court and see what a judge says. If it's under £5k it will probably be small claims court only. If it's over that it may be worth instructing a solicitor. They will have to demonstrate a contract.
