Sole Agent and minimum periods?

I have a 16 week sole agent agreement with my Estate agent which includes the clause "the minimum period will not include any period of time where you have asked us to cease or suspend marketing". The property went on the market day 1, and was under offer day 2, the agent asked to take the property off the market and we agreed to do so. This offer fell through and was put back on the market day 20, day 21, a second offer was made and accepted again we were asked to take the property off the market and agreed. Day 105 (after numerous attempts to get the agents to find out why the delay) we were informed that the buyer could not get a mortgage (despite reassurances from the agent) day 106 back on the market - no offer as yet (because we believe the agent is stalling us while awaiting a new mortgage offer to come through - buyer is a friend of agent). When I went in to close the agreement I am told that the minimum period still has weeks to run as the property was off the market for a time!

  • "where you have asked us to cease or suspend marketing" I think that would not be the case if "agent asked to take the property off the market" Change your agent, even if it means waiting until the agreement expires before remarketing.
