Who owns the garden?

We are in process of buying a ex-council flat , the property has 2 gardens ( front and rear) , private garden( rear garden fenced of) ; but when we received a copy of the old lease from the seller and the map from land registry, both gardens are not showing . The lease and the map are quite vague actually ( circa 1970s) not precise at all. The seller bought the property from the council so she is the only ever owner of the property - apart from the council. This is currently with our solicitor but the sellers solicitors has not come back to us- his replies are normally on the lines : "rely on your own searches". We are running out of time ( lease on the rental property is due to expire so we will be homless). Does anyone have seen or experienced similar situation? What are my options? Is there anything i can do in the meantime - since both solicitors seem not to be in a hurry. Thanks in advance

  • You would need to check with your local planning office to confirm boundaries and ownership.

  • You should do a check with the /and Registry. If the property is registered the Land Registry plan will show the boundaries and what is included.

  • Threaten to take the solicitor to the legal ombudsman if he doesn't get his finger out. Then: 1. Tell him to do an index map search of the affected area (costs you £5). 2. Then with this tell him to retrieve the titles of the land registry title numbers shown on the index amp search - this will show you who the proprietors of the land are although I suspect the land may still belong to the freeholder - the council?
