My brother is the executor of our mothers will, can my brother sell the house before the will is read out? Without my permission, even if half is mine?

  • Before your brother can sell the property probate will need to be granted so if you are entitled to half of the property you get your far share.

  • The short answer is no. You can market a property for sale and indeed introduce a buyer, but a property cannot exchange without a valid grant of probate. Speak to the solicitor handling the estate if your are both executors you have equal rights and therefore say.
