Estate agents contracts

I have had my house on sale for 4 weeks with an estate agent but am not happy. I was told that I could take it off the market after giving 7 days notice in writing without being charged, but because I have signed a 12 week contract I cant put in on the market with any other agent until the 12 weeks is up. Is this correct because am I not terminating that contract with the estate agents by taking my house off the market with them. If it's correct what are the consequences?

  • You are probably tied into a "Sole Agency" agreement with your estate agent, which means that you are unable to instruct the services of another agent during the specified term with out their authority. The consequences of ignoring the agreement are that you could be liable to two sets of fees should the new agent find you a buyer.

  • If you are simply taking the house off the market until the 12 week period is up, then you can do so by simply giving them their 7 days notice. If you are not happy with their services, simply take the property off the market and go on as a new instruction with another estate agent once the 12 week period is up.
