Using agents' photographs

Is it illegal to use photos to market a property if those photos were taken by a previous agent outside of their contract?

  • Agent 1 won’t like it but illegal is a bit strong. If you paid for them of course, they are likely yours anyway.

  • ANY photographer owns the copyright to all the photographs he/she/ takes unless you have employed them an they received payment for them. EA's are usually too busy to bother these days but they do have the right to demand your usage cease and you could end up in court.
