Seller of the property I'm thinking of buying wants to keep the garage at end of garden. Is this legal?

Owner has put a fence up in garden because he wants to keep garage and a bit of garden both located at the end of the garden. He is not going to change boundaries at Land registry office because it costs too much, the estate agent told me the deeds of the house will have the garage taken off them. Can the owner do this?

  • Yes provided that both parties agree to it and the appropriate formalities are adhered to. His reason for non registration is idiotic he could easily sell you everything but the portion he is retaining. Somewhere along the line a land reg entry must be made to reflect your ownership. If he fails to register and you subsequently sell the entire property including his bit, he will not have any redress against the Land Reg.
