Stamp Duty Query Regarding 3% Surcharge

Hi I moved out of my previous main residence in August 2014 into rented accommodation in order to decide whether I was happy to live in a new area. I had lived in that property for over 10 years before moving out. Since then I have rented out my previous main residence and have been renting up until now. I have now found a house that i want to buy, but believe `i will be liable to pay stamp duty including the 3% surcharge for second properties. If I buy the house I have found and then subsequently sell my other property, will i be able to claim back the stamp duty surcharge and if so what would be the timescales for doing so? I do own another property in Spain.

  • Hello David - I think you may struggle claiming it back as the Stamp Duty refund applies to the sale of any property that has been your only or main residence at some point during the 36 months leading up to the new purchase. Probably best to speak to an accountant about this to confirm. If I´m wrong, it would be interesting to hear.
