Ground floor conversion flat patio sold as part of the flat is not

I put an offer in on a ground floor flat, the details listed that the patio was owned by the flat and the rest of the garden was communal. This was stared on the estate agent details and confirmed by the owners when they showed me round on the 2nd viewing. It turns out it is not, it is part of the communal gardens. I think this has a bearing on the price but also the desirability and really that is was misrepresentation. Is there a value to the patio not being included and if so how can I work it out?

  • The value is how much less you are prepared to pay given this new information. Or, if you withdraw your offer will the vendor readily find a new buyer at the original price.
