Legal Charge still on a property I bought 6 months ago.

I paid cash for the apartment, 6 months later I checked on the HM Land Registry and the previous owner's name was still on the property. I emailed my solicitor who in turn emailed the seller's solicitor and they say the builder who sold them had a charge on it (I understand this to be a first time buyer loan). This is still in on going, but the previous owner must pay that loan before my name is entered on the deeds ? ? ? Can you advise me on this?

  • Hello Stevie, This shouldn't have been allowed to exchange and complete if there are uncleared secured debts. I would go back to your solicitor - it's serious that contracts were exchanged with this underlying debt still in place... Feel free to post any further questions on here. Thanks, Ruban
