Is my landlord within his rights?

My landlord arranged to bring an Estate Agent round for a remortgaging valuation. He kept me talking in the garden and unbeknown to me and without my permission a video and pictures were taken of the property interior. It shows all my private contents, bedrooms, etc. Next day I received a 2 months notice to quit and a 'For Sale' sign was erected in the garden. Can I request that this video/slides be removed from the internet as it was taken without my permission or knowledge? I only found out it was on the internet when people turned up out of the blue this weekend, looking at the outside of the property. Do you have any rights as a tenant?

  • Hi KateCarol, In terms of bringing someone to the property to carry out a valuation, I assume the landlord stuck to their tenancy agreement terms and advised you of the visit within the specified timescale? If not, then you would definitely have grounds for complaint if they just turned up out of the blue. With regards to the pictures, is it something that is possibly specified in your tenancy agreement? It would be normal for them to need photographs if they are going to be selling a home, and this cannot normally be done when the property is empty, for obvious reasons, but if the landlord has mislead you and distracted you while they were taken deliberately then that would be unfair. It would be worth calling your landlord and asking about the photos to see if they would be able to remove any you are uncomfortable with. Many thanks, Scott

  • They also normally need to give written notice that they are going to turn up.

  • Make a written complaint to your landlord and the estate agent that took the photographs. Request they take them down, they did not seek permission, and it also poses a security risk to you. Your possessions and the 'lay' of your property are now readily available on the internet. Perhaps the landlord didn't ask, because they didn't want to hear a no!
