Can I void my estate agent contract?

I was 5 weeks into contract with a local estate agent, during this time we only had 3 viewings. Finally a property came up for sale in our area, we didn't want to miss this property so a parent offered to take ownership of our property just temporarily while it sold. This way we were able to move. We told our estate agent and they were OK with it as long as the new owner signs another contract but for a longer term which we agreed. Since then we ran into a speed bump. The new owner isn't legally allowed to sell for 6 months. Now the estate agent say they want their full fee for this private sale! I have advised them that they can still market the property until they find a new owner but they refused... Please help any advice would be great. Thanks

  • Hello - there may be a clause in the small print that protects the estate agents in such situations. I would take a closer look at it and see where you stand. You may want to take it to the local Citizens Advice Bureau if you're still not clear.
