Estate Agents breach of contract?

My estate agents has gone bust and I am mid way through a sale, having found both a buyer for my property and having had an offer accepted for a new property. I signed with a new Estate Agents in order to continue the sale, but now my original Agent has informed me that they have transferred all business to another Agents and are threatening me with a bill potentially of thousands for Breach of Contract. Have my original Estate Agent broken their contract with me (they never removed my property from their website or updated it to sold, which I feel are reasonable steps to take, or communicated about the transfer of business in any way), or am I at risk of breaching it with them?

  • It sounds like they have breached the contract and not you - as you would have continued with the sales of both properties through them had they not gone bust. I would suggest contacting The Property Ombudsman (TPOS).
