Paying the agency fee??

My tenant was interested in buying my property but wasn't sure if he was able to raise the funds. We therefore agreed I would put the property on the market with an agent. He has now managed to sort out his finances and has given me an offer to buy. As we had discussions prior to the agent's engagement, and he is not a buyer introduced by the agent in anyway, do I still have to pay the agent's fee even if we wait to transact the sale after the contract term? I was never asked by the agent if there were any interested parties at the time of signing the contract, although obviously they were aware that he had initially expressed an interest but couldn't raise the funds - that was why I decided to put the property on the market in the first place. Any advice greatly appreciated!

  • You should only have to pay the agent if your property is sold to someone who found the property through them.
