The property comprises a former plant Nursery situated in a pleasant semi-rural setting adjoining Middle Lane, Timbersbrook being approximately 1 ½ miles from the market town of Congleton, approximately 9 miles from Macclesfield, 15 miles from Crewe and 12 miles from Stoke on Trent. The A54 Congleton to Buxton Road is approximately 150m distance.

The Nursery extents to 0.9 acres or thereabouts in an irregular shaped parcel with frontage and access directly onto Middle Lane. It is understood that it previously operated as a plant nursery.

Overage Agreement

Also known as Claw Back or Uplift. The vendors’ and purchasers’ solicitor will agree the complexity of wording of overage contract (at the time of purchase). The basic terms of the agreement between the buyer and seller are as follows:
1. The length of overage is for a term of 25 years and will apply to any successive buyers during the said term.
2. There will be a 25% payment to the seller created by the uplift in value of the agricultural land due to the granting of any planning permission.
3. The overage will fall due when development commences not on the granting of planning permission, or on the sale of the property with planning permission.

Tender Procedure

1. Tender forms are available on application from the Agents.

2. Tender forms must be completed in full and include:

(a) The name, signature and address of prospective purchaser;
(b) The amount of the offer in pounds sterling in figures and words;
(c) The prospective purchaser will agree to exchange contracts within 28
days of written acceptance;
(d) The Agents reserve the right to verify that the necessary funds are in
place before the purchaser is informed of acceptance of his/her offer.

3. The closing date for tenders will be 12 noon on Friday 20th September 2019
and should be delivered to the offices of Timothy A Brown, 2-4 West
Street, Congleton, Cheshire CW12 1JR in sealed envelopes marked 'The Nursery, Middle Lane, Congleton'.
