The property provides an opportunity to
purchase land and mature woodland in a rural
area yet situated close to Ashby de la Zouch,
Swadlincote and Burton on Trent with potential
for agricultural or amenity uses (subject to
consents) which has been reinstated. The land
is accessed off Coopers Close.

We are not aware of any services connected to
the land.

Overage clause
The property will be sold with the reservation of
overage in favour of a previous owner and their
successors in title on the following basis:
On the date of completion to the 31 July 2030 a
50% overage. From 1 August 2030 - 31 July
2040 a 25% overage.

The overage is triggered on the basis of grant of
any non-agricultural development as defined by
the prevailing use classes from time to time
over the whole or part of the Property. For the
avoidance of doubt the overage is not triggered
by agricultural or equestrian development.
Such a payment will be payable on either the
implementation of works with the benefit of
planning or on the sale of the Property with the
benefit of planning. The overage will be payable
on the difference between the purchase price
and the market value (of part if appropriate) as
at the date that the overage is payable less the
purchase price and costs including that of the
planning fee in the submission of obtaining
planning consent.
Note; restriction on title - No disposition
registered without Deed of Covenant in favour of
the Original Seller (or successor) to comply with
Overage Provisions.
