Overage clause The property will be sold with the reservation of overage in favour of a previous owner and their successors in title on the following basis: On the date of completion to the 31 July 2030 a 50% overage. From 1 August 2030 - 31 July 2040 a 25% overage.
The overage is triggered on the basis of grant of any non-agricultural development as defined by the prevailing use classes from time to time over the whole or part of the Property. For the avoidance of doubt the overage is not triggered by agricultural or equestrian development. Such a payment will be payable on either the implementation of works with the benefit of planning or on the sale of the Property with the benefit of planning.
