Prospective tenants interested in renting a property through Atlas Property Letting & Services Ltd will need to be aware of the following pre-tenancy costs due prior to the commencement of a tenancy:
A one week holding deposit is to be paid to a landlord or letting agent to reserve a rental property before the signing of a tenancy agreement. The deposit can only be held by the Agent or Landlord if the Tenant:
1) Backs out
2) Does not take reasonable steps to start the tenancy
3) Fails a right to rent check
4) Provides misleading information
Landlords/agents can only hold onto this deposit for 15 days, unless you’ve agreed another date in writing. After the deadline you must pay the tenant the deposit within seven days.
If a tenant does back out before the deadline for agreement, you must give written notice explaining why the holding deposit isn’t being repaid. This must be done within seven days of the decision not to enter a tenancy agreement having been made.
Prior to the tenancy, you will be required to pay a maximun of five weeks' security deposit.
Changes to A tenancy:
Any changes requested on the existing tenancy there will be a charge of £50 or higher, depending on the cost of the nature of changes involved.
Terminating A tenancy early
Any charges associated with the early termination of a contract are still valid, but they must not exceed the loss incurred by the landlord (usually the cost of any lost rent or non-recoverable commission fees already paid by the Landlord to the Agents as a result of a tenant leaving early).
If you agree to a tenant leaving early, you can ask them to pay their rent as required by the tenancy agreement until a replacement tenant is found. However, if they're exercising their break clause by leaving early, you cannot charge them.
