Situation
The Cannock Chase Area of Outstanding Natural Beauty is a nationally protected landscape located in Staffordshire. Covering over 16,000 acres, it lies between the towns of Cannock, Rugeley, and Stafford.

Designated an Area of Outstanding Natural Beauty (aonb) in 1958, the Chase is known for its extensive heathland, mixed woodland, and open countryside, which provide important habitats for wildlife such as deer and rare birds. The area also contains a range of notable landmarks including Castle Ring, one of the best-preserved hill forts in the Midlands, and the German Military Cemetery at Brocton.

As a result, Cannock Chase is valued both for its natural beauty and for its historical and recreational significance.

Planning and Section 106 Agreement
The whole of Lot 1 is to be sold subject to ongoing management and conservation scheme under a Section 106 Agreement dated 12 April 2006. The current conservation scheme has been created by the Royal Society for the Protection of Birds (rspb) and approved by Staffordshire County Council.

Prospective purchasers are advised to undertake a detailed review of the conservation scheme requirements and timings, to fully ascertain the ongoing associated costs. Further information is available from the selling agents.

The Property is subject in part to a right for the Vendors to enter the Property for the purpose of complying with any outstanding
restoration obligations and conditions contained in the Section 106 for Property retained by the Vendor but which may affect the Property being sold. The Purchaser agrees to enter in to any subsequent agreement or obligations as required under this clause subject to the Vendor indemnifying the Purchaser against all liabilities, expenses, costs (including but not limited to any solicitors’ or other professionals’ costs and expenses), claims, damages and losses suffered or incurred by the Transferee arising out of or in connection with any breach of any of the Transferor’s obligations contained in the Section 106 Agreement.

The selling agents will not provide advice/guidance on the planning history for the property/land. Interested parties are advised to make their own investigations. It is assumed that enquiries have been satisfied, prior to an offer being made.

Plans and boundaries
Many of the boundaries shown on the sale plan are not physically demarked. Purchasers will need to make independent enquires and satisfy themselves as to the ownership of boundaries.

Access
Lot 1 – can be accessed from Kingsley Wood Road, the bridleway off the intersection between Stafford Brook Road and Wolseley Road (the Rugeley Quarry site entrance), as well as from areas of Cannock Chase not contained within this sale.

Lot 4 – can be accessed off the A513, on the opposite side of the road to the Wolseley Arms Public House.

There are no known services connected to any of the land. The Vendor offers no warrant in regards of services.

Tenure
It is understood that all of the land is to be sold freehold with vacant possession, subject to historic leases and agreements.

The sale area is made up of multiple registered Titles and as such may be subject to a Transfer of Part and the preperation of Land Regsitry Compliant Plans. Part of Lot 1 is unregistered.

Lot 1 is situated within the Cannock Chase sssi.

Areas of Oustanding Natural Beauty (aonb)
All of the property is situated within the Cannock Chase aonb and is within a Green Belt.

Nitrate Vulnerable Zone (nvz)
All of the property is within an nvz.

Sporting, Mineral and Timber rights
Sporting and timber rights will be included in the sale in so far as they are owned. Mineral rights will be excluded from the sale by the Vendor.

Lot 1 is subject to a Sport Licence, further details are available from the selling agent.

Overage
The property is subject to an overage clause, whereby 50% of any increase in value of the property from the grant and implementation
of planning permission for Residential or Commercial development on the Transfer or Sale of the property would be payable to the Vendor. This would include any development which occurs under Permitted Development Rights. The term of this clause would be 25 years from the date of completion.

The sale will be subject to a 12-month disposal overage of 50% of the uplift in value from a sale of the whole or part of the site within 12 months following purchase.

VAT
The Vendor has not opted to tax under Value Added Tax. Should any sale or any other part of the land or any right attached to it become a chargeable supply for the purposes of Value Added Tax (VAT), such tax will be payable by the Purchaser(s) in addition to the contract price.

Method of sale
The property is offered for sale by Informal Tender method. However the vendor reserves the right to conclude the sale by an alternative method if required.

Public rights of way, wayleaves and easements
The property is sold subject to all rights of way, wayleaves and easements whether or not they are defined in this brochure.

There is a Western Power Distribution overhead 11kV power line crossing small areas of Lot 1 along the southern and
south eastern extremities. It is understood that there is a Local High Pressure National Grid Gas main following the eastern boundary of Lot 4. All of the land is registered with the Land Registry under the following title references:
