Many properties in Whitby and Robin Hoods Bay are subject to ancient Chomley leases. Sir Hugh Chomley - Knight of Whitby owned swathes of land in Whitby and Scarborough during the reign of Charles I (1600s). Sir Chomley granted leases of land in Whitby to individuals usually for a term of around 1000 years.

These properties are therefore still classed as leasehold even though in many cases the lease has been lost and thus the details are unknown. However, they are not like usual leasehold properties where owners pay a ground rent to a freeholder and the freeholder is responsible for insuring the property etc. This is because the freeholder is absent due to the age of the leases.

Indemnity insurance can be obtained to cover properties subject to old Chomley leases. This costs around £100-200.00 and is a one-off premium. Such policies protect property owners and mortgage lenders if, for example, an heir of Sir Chomley ever found a copy of one of the original leases and tried to enforce its terms on property owners i.e. Demand rent. Obviously, this is highly unlikely but offers buyers peace of mind.
