Zoopla Plus terms and conditions

1. General

1.1 These Terms and Conditions ("Terms") supplement our www.zoopla.co.uk Website Terms and Conditions which are incorporated into these terms and can be found here. Any defined terms or meanings in our Website Terms and Conditions will apply here unless the context otherwise requires.

1.2 We may amend these terms from time to time. Every time you wish to use our websites, applications or platforms (“Sites”), please read and carefully check these terms to ensure you understand the terms that apply at that time.

1.3 These terms apply when you use www.zoopla.co.uk or other ZPG Sites: i) to request and purchase a Zoopla Plus Property Report and Zoopla Plus data and insights(one-off or Subscription) (as defined at Clause 3 below) or other similar digital product or service from Zoopla or our third party partners and providers (“Third Parties”)); ii) for the production of your personalised digital product or service; iii) the processing of your purchase and payment through a third party payment provider; iv) when you provide your contact details to allow us or a third party to contact you and or deliver to you the requested and or purchased product or service in a digital downloaded format; v) to otherwise be able to provide you with digital products and services; and vi) to promote and market products and services (“Zoopla Digital Products and Services”). By using www.zoopla.co.uk or purchasing any Zoopla Digital Product or Service through our website or mobile app, you are agreeing to these terms and conditions.

1.4 Zoopla Limited is a company incorporated in England and Wales with registered offices at The Cooperage, 5 Copper Row, London, England, SE1 2LH (Company Number 06074771) ("Zoopla", "our", "we" or "us").

1.5 Zoopla is a subsidiary of ZPG Limited. Any reference in these terms to the Group includes all direct or indirect holding or subsidiary undertakings (defined in the Companies Act 2006)  of ZPG Limited

1.6 Third parties may help us to promote, market and deliver Zoopla Digital Products and Services.

2. Requesting and delivering Zoopla Plus

2.1 Zoopla Plus (including our Zoopla Plus Property Report) is provided on an  ‘as is’ basis without any express or implied representations or warranties and results and the Zoopla Plus content is based on the information you give to us and the collation of data from various third parties as at the date we provide the Zoopla Plus Property Report and Zoopla Plus data and insights. To the fullest extent permitted by applicable laws, Zoopla Plus is provided on a non-reliance basis. You must not make any decisions about your property without taking independent legal and/or professional advice.

2.2 We rely on the information you input in order to find information about the correct property and produce the Zoopla Plus Property Report and Zoopla Plus data and insights. To request a Zoopla Plus Property Report and Zoopla Plus data and insights you will be required to input certain information about your property and provide us with an email address for delivery of the digital report.  We are not able to produce a report without required information from you. We are not liable for any factual inaccuracies caused by the information you input. 

2.3 We will provide the Zoopla Plus Property Report and Zoopla Plus data and insights to you within a reasonable timeframe.

2.4 Nothing in these terms affects your statutory rights. However, please note that in respect of one-off Zoopla Plus Property Report purchases, as you are purchasing a downloaded report, once you receive the report your right to cancel and the entitlement to a cooling off period under the Consumer Contracts Regulations 2013 will no longer apply. In respect of Subscriptions, please see Clause 9 below. Your order is an express instruction for us to start the services to provide the Zoopla Plus Property Report immediately.  Any Refund is at the discretion of Zoopla subject to Clause 9 and compliance with all law and regulation. 

2.5 Your one-off purchase or Subscription (as defined below) may be delayed or cancelled where: (i) an event outside of our reasonable control prevents us from gathering all relevant information to provide the Zoopla Plus Property Report and Zoopla Plus data and insights; (ii) third party systems are unavailable meaning we cannot collate the relevant information;  (iii) where no documents are available with respect to the property information you have provided;  (iv) we have been unable to take payment or (v) your use of the Subscription is found to be not for personal purposes or is otherwise considered unreasonable at the sole discretion of Zoopla. 

2.6 The Zoopla Plus Property Report and Zoopla Plus data and insights are generally not available in hard copy, although please contact us if you require any reasonable adjustments and we will try to facilitate where reasonably possible to do so.  

2.7 We may withdraw any goods and services at any time, however, this will not affect orders already placed and accepted for the Zoopla Plus Property Report and Zoopla Plus data and insights. 

2.8 We may contact you (including but not limited to via email, telephone call, SMS or app push notification) if we require further details or information from you to provide the the Zoopla Plus Property Report and Zoopla Plus data and insights, including verifying your identity, or to request more information if we cannot identify the property you are requesting the Zoopla Plus Property Report and Zoopla Plus data and insights for. 

2.9 You should not submit details or information relating to any other person unless you have the authority to do so for a joint request.

3. Zoopla Plus Subscription

3. 1 In addition to a one-off purchase of a Zoopla Plus Property Report, we offer a subscription service (“Subscription”) to customers which provides subscribers with certain benefits and discounts, detailed at Clause 3.6 below, upon payment of the Fee displayed on our Site at the time of subscribing (“Subscription Fee”).  

3.2 For the avoidance of doubt, you are under no obligation to purchase a Subscription in order to access a Zoopla Plus Property Report and may choose to use our one-off option instead.

3.3 Any Subscription is subject to the fair usage terms set out below and by purchasing a Subscription, you acknowledge and accept these terms and conditions.

3.4 The Subscription may only be used by the named account holder for their personal use and is not transferable. We reserve the right to monitor your usage of your Subscription. 

3. 5 Your Subscription will begin on the date we send you an email confirming activation and will automatically renew on a monthly rolling basis in accordance with Clause 10 below.

3.6 In return for payment of the Subscription Fee, during your Subscription we will offer you 10 Zoopla Plus Property Reports per calendar month subject entirely to Clause 3.7 and Clause 7 respectively.

3.7 We reserve the right to limit the number of Zoopla Plus Property Reports ordered if, in our opinion, the quantity of Zoopla Plus Property Reports is frivolous or vexatious, or jeopardises the availability of any Zoopla Digital Products or Services.

3.8 If you owe us any outstanding monies, your Subscription may be suspended and only re-activated at our discretion. We will not under any circumstances reactivate the Subscription until such time as the outstanding balance has been paid in full, or you change or update your payment card details via Stripe to a card that can be successfully charged the Subscription Fee and any monies owed to us.

3.9 If your Subscription is suspended by us, your renewal will continue once the Subscription is made active again. You will forfeit the use of your Subscription during the period you have been suspended, and in the case of termination or suspension by us, you shall not be entitled to receive a refund of any or your Subscription Fee.

3.10 By purchasing a Subscription, you agree to receive emails providing further information about the Subscription service, but remain free to opt-out of marketing messages at any time.

4. Intellectual property

ZPG and/or its third-party licensors own all intellectual property rights in the Zoopla Plus Property Reports, the Zoopla Plus data and insights, and other Zoopla Digital Products and Services. You must not sell, rent, sub-licence, reproduce, duplicate, copy or otherwise commercially exploit any Zoopla Plus Property Reports, the Zoopla Plus data and insights or other Zoopla Digital Property Product and Services, they are strictly for personal use only.

5. Payment

5.1 Payment is required at the time of purchase (whether one-off or Subscription)  and is non-refundable unless we specify otherwise. A valid payment method is required to process payment for Zoopla Digital Property Product and Services. You agree to provide true, accurate and up to date billing information including your full name, address, contact details and valid payment method information. You can update or correct your details at any time by following the link under your Zoopla Account > Subscription page, which will redirect you to Stripe’s dashboard where you can make the necessary amendments. 

5.2 You authorise ZPG or its group companies to charge a fee either as a one-off or a Subscription Fee as specified on our Site at the time of purchase (“Fee”) for the Zoopla Digital Property Product and Services. This Fee is subject to variation from time to time at Zoopla's sole discretion. If you are on a monthly Subscription, you will be contacted if there is a change in the price of your Subscription prior to the upcoming payment date. 

5.3 To process your payment of the Fee we use a trusted third party payment processor - currently Stripe, contactable here. We do not store your bank details following completion of the transaction. You must agree to the payment processor’s terms and conditions and privacy notice to use the payment services. We may change our payment processor, and if we do so, you will be informed at the time of purchase.   

5.4 If we agree to issue a refund, we will issue the refund to your original payment method on receipt of funds from our third party payment processor. We will not be responsible for any delays for your receipt of the refund that is caused by a third party.

6. Privacy

6.1 By submitting your details, requesting Zoopla Plus Property Reports, Zoopla Plus data and insights  or any other Digital Products and Services and paying the Fee you agree that we will process your information in accordance with our Zoopla Plus and Zoopla Website Privacy Notices

6.2 To produce Zoopla Plus Property Reports and Zoopla Plus data and insights, we require property information from you (which does not constitute personal data). You agree that when you input this information, this property information may be shared with third parties for purposes not related to you.

7. Acceptable use

Your use of Zoopla Plus and any other Zoopla Digital Products and Services is subject to the acceptable use requirements in our Website Terms and Conditions or otherwise provided by us from time to time.  We reserve the right to immediately terminate or suspend your account at our sole discretion on giving you notice of the same. Clause 3 of these terms further defines the acceptable use of a Subscription.

8. How far we are responsible

8.1 We draw your attention to clause 2.1 of these terms which set out how far we are responsible for Zoopla Plus. In any event, ZPG and each member of its  Group will not be liable to you for any indirect or consequential losses. Nothing in these terms excludes or disclaims liability for any liability which cannot be limited, excluded or disclaimed under applicable laws. By purchasing Zoopla Plus and any other Zoopla Digital Products and Services, you agree these limitations are reasonable. 

8.2 If any clauses of these terms are deemed unenforceable, this will not affect the other terms in the agreement.

9. Refunds

9.1 Subject to clause 9.4, if you have made a one-off purchase of a Zoopla Plus Property Report, you are able to request a full refund within 90 (ninety) days of completing the initial purchase, by following the links provided on the Zoopla Plus Property Report.

9.2 If you have purchased a Subscription, you have the right to change your mind and cancel your Subscription within 14 (fourteen) days of completing the Subscription purchase (“Cooling Off Period”) and, provided you have not used your membership in that time, you may request a full refund of the Subscription Fee.

9.3 After expiry of the Cooling Off Period, you are still able to cancel your Subscription at any time, but will no longer be eligible to receive a full refund. 

9.4 Once a Zoopla Plus Property Report has been downloaded and as per Clause 2.4 a refund is at the sole discretion of Zoopla, subject to compliance with all law and regulation. For the avoidance of doubt, Zoopla’s refund procedure does not affect your statutory rights. For further information about your legal rights, you may contact Trading Standards or the Citizens Advice Bureau.

10. Auto-renewal

10.1 The Subscription shall auto-renew on a monthly rolling basis. We will send a notification to the email address used to complete the initial payment 7 (seven) days before the next upcoming payment is due (“Renewal Date”) alerting you to this.

10.2 Unless you notify us before the Renewal Date that you do not want to automatically renew and that you wish to cancel your Subscription on expiry of the current month’s term, you understand that your Subscription will renew for another month and that payment will be automatically taken from the payment card on record. Completion of your initial Subscription purchase is an authorisation for Stripe to use this payment card unless you decide to cancel your Subscription in accordance with these terms.

11. Cancellation

You will be able to cancel your Subscription at any time by following the links under your Zoopla Account > Subscription.

12. Complaints

12.1 Any questions, comments or complaints should be submitted via the Zoopla Help Centre. Our first port of call will be to direct you to the most relevant answer on our Help Centre FAQs. 

12.2 Should this fail to resolve your issue, we will escalate the matter to a member of our support team.

13. Governing law and jurisdiction

These terms are governed by English Law and any contractual or non-contractual disputes arising out of or in connection with Zoopla Digital Products and Services including Zoopla Plus will be subject to the exclusive jurisdiction of the English Courts.
