Product Testing Terms and Conditions

Unless otherwise stated, the defined terms and rules of interpretation in the Member Terms and Conditions shall apply to these Product Specific Terms and Conditions. “Member Terms and Conditions” means the member terms and conditions linked in the Order Form and made available to Members on the Website(s).

These additional terms relate specifically to the provision of the additional services described below and together with the Order Form and the Member Terms and Conditions constitute the Contract.

In these Product Specific Terms and Conditions, the following additional defined terms shall have the following meanings:

“Commencement Date” means the date on which You or your employees, agents or staff access any Product Testing Services; 

“Product Testing Services” means any services, products or applications made available to You by Zoopla (or a member of its Group); and

“You” means the entity named on the cover letter.

1. You agree and acknowledge that the Product Testing Services (i) are considered to be ‘pre-release’ and are still undergoing development, testing and evaluation in its testing stage, (ii) are provided to you on an ‘AS IS’ or ‘AS AVAILABLE’ basis and may contain bugs, errors and other problems associated with being a testing service and to the extent permitted by applicable law, Zoopla expressly disclaims all representations, warranties, guarantees and conditions of any kind (whether express or implied), including any warranties that the Product Testing Services will meet Your requirements; and (iii) may be subject to further testing by Zoopla in the course of providing the Product Testing Services to you. You also agree and acknowledge that Zoopla has not made any representations, promises or guarantees that the Product Testing Services will be made generally available to its Members in the future. In exchange, You acknowledge and agree that You are being charged lower testing fees or no fee for the Product Testing Services.

2. Subject to the Contract Zoopla (or any member of its Group as Zoopla may determine) will provide You with the Product Testing Services. Zoopla may change or discontinue the Product Testing Services from time to time. Any changes by Zoopla will be made in accordance with clause 2 (Contract Changes) of the Member Terms and Conditions. To the extent Zoopla discontinues the Product Testing Services, Zoopla will do so in accordance with clause 4 of these Product Specific Terms and Conditions.

3. You warrant and represent that:

a. You shall provide Zoopla with all of the Content required by Zoopla to carry out the Product Testing Services; and

b. any Content you provide shall comply with the Member Terms and Conditions.

4. Zoopla may terminate the provision of the Product Testing Services with immediate effect at any time and without notice. You may terminate the Contract by serving not less than 14 days’ written notice.
