Product Specific Terms and Conditions

Pay Per Listing Terms and Conditions

In these Terms and Conditions the following terms shall have the following meanings:

Administration Fee: shall be the fee set out in the order form. 

Agent Category: shall be the category set out in the order form. 

Pay Per Listing Fee(s): means the fee payable by the Member as calculated in accordance with clause 6 of these Terms and Conditions. 

Listing: a single property advertisement on the Website uploaded by the Member  but shall not include Listings which are marked “sold”, “subject to contract” or “let agreed”.

Listing Cap: means 10 Listings per month during the Term

Listing Fee: means the fee as set out in the Order Form. 

1. Except as set out above, definitions used in these Pay Per Listing Terms and Conditions shall, unless otherwise indicated, have the same meanings as those given to them by the Member Terms and Conditions and references to clauses shall be to clauses in these Pay Per Listing Terms and Conditions unless indicated otherwise. 

2. Where agreed in the Order Form, the Member shall be granted access to, and shall be permitted to use the Pay Per Listing services, which will be provided by Zoopla (or any Group Company as Zoopla may determine),  subject to these Pay Per Listing Terms and Conditions. 

3. These Pay Per Listing Terms and Conditions relate specifically to the provision of the Pay Per Listing Services and are in addition to, not the exclusion of, the Member Terms and Conditions which, unless otherwise agreed with Zoopla  in writing apply to all Services provided by it (including for the avoidance of doubt, the Pay Per Listing Services) and the Member agrees to comply with these Pay Per Listing Terms and Conditions as well as the Member Terms and Conditions in relation to its receipt of Pay Per Listing Services as well as any other Product Specific Terms and Conditions that pertain to other Services it receives from Zoopla and the Order Form.

4. Where these Pay Per Listing Terms and Conditions conflict with the Member Terms and Conditions in relation to a matter specifically pertaining to Pay Per Listing Services, these Pay Per Listing Terms and Conditions shall prevail and in all other cases the Member Terms and Conditions shall prevail.

5. Subject to clause 7 and 8 below, the Pay Per Listing(s) Fees shall be calculated by reference to the number of available Listings on the Website per month multiplied by the Listing Fee. For example, if a Member uploads a Listing in February and it is marked as sold in May, the Pay Per Listing(s) Fee will be calculated as 4 (the number of months the Listing is live on the Website) x the Listing Fee. 

6. In addition to the Pay Per Listing(s) Fee,  the Member shall pay the Administration Fee to Zoopla each month of the Term.

7. Pay Per Listing(s) Fees shall be invoiced in arrears on or around the 1st day of each month and the invoice shall become payable 14 calendar days after the invoice date.

8. Zoopla shall be under no obligation to make the Pay Per Listing service available and Zoopla may discontinue the Pay Per Listing service at any time without notice or liability. In addition, Zoopla may vary the Pay Per Listing services from time to time with or without notice to the Member.

9.  All intellectual property rights in the Pay Per Listing service shall belong to Zoopla and/or its licensors/sub-contractors and Member shall have no rights in, or to, such intellectual property other than the right to use the same in accordance with these terms and conditions.
