Prospect Plus (CPL) Leads Terms and Conditions

Unless otherwise stated, the defined terms and rules of interpretation in the Member Terms and Conditions shall apply to these Product Specific Terms and Conditions. “Member Terms and Conditions” means the member terms and conditions linked in the Order Form and made available to Members on the Website(s).

These additional terms relate specifically to the provision of the additional services described below and together with the Order Form and the Member Terms and Conditions constitute the Contract.

In these Product Specific Terms and Conditions, the following additional defined terms shall have the following meanings:

Cost per Lead means the cost per Lead as set out in the Order Form;

Initial Term As stated in the Order Form;

Lead Cap means the monthly maximum Fee charged for the Leads under Prospect Plus (CPL) Services as stated in the Order Form, if any; 

Start Date as stated in the Order Form; and

Prospect Plus (CPL) Services means the Prospect Plus (CPL) services provided by Zoopla to the Member in consideration of the Fees paid for this service.

  1. Where agreed in the Order Form, the Member shall be granted access to, and shall be permitted to use, the Prospect Plus (CPL) Service, which will be provided by Zoopla (or any Group Company, as Zoopla may determine), subject to these Prospect Plus (CPL) Terms and Conditions.

  2. Where these Prospect Plus (CPL) Terms and Conditions conflict with the Member Terms and Conditions in relation to a matter specifically pertaining to Prospect Plus (CPL) Services, these Prospect Plus (CPL) Terms and Conditions shall prevail and in all other cases, the Member Terms and Conditions shall prevail.

  3. The Member can only use the Prospect Plus (CPL) Service where it has subscribed to the Valuation Booster services in the same area. The Member can select the Prospect Plus (CPL) Services for certain value property leads. If the Member stops subscribing to the Valuation Booster services during the term of these Prospect Plus (CPL) Services, the Member will cease to be able to use the Prospect Plus (CPL) Services,

  4. Subject to the payment of the Cost Per Lead as specified in this Order Form, Zoopla will provide the Member with Leads via their ZooplaPro account and/or via email or as otherwise determined by Zoopla. In addition, Zoopla will provide the Consumer with a unique telephone number to contact the Member should they choose to.

  5. The Member will provide Zoopla with all of the information Zoopla requires in order to provide the Leads to the Member, including but not limited to an email address for notification of the Leads.

  6. For the avoidance of doubt, nothing restricts Zoopla from engaging with other third parties to provide introductions that are the same or similar to those provided by Zoopla under this Order Form.

  7. At the end of each month Zoopla may request that the Member discusses with Zoopla the quality of the Leads provided and their conversion rate. Where possible, this information will be shared back as aggregated and anonymised data or if this is not possible and Personal Data is shared back, this will be done in compliance with Data Protection Legislation and the Data Protection Schedule.

  8. Zoopla reserves the right to stop providing Leads to the Member at any time. If this happens, Zoopla will provide the Member with a statement of reasons explaining the specific facts and circumstances that led Zoopla to making the decision to stop providing the Member with Leads.

  9. The Member will pay Zoopla the Fees which are calculated on the Cost per Lead for each Lead received in a month, subject to any Lead Cap. Zoopla will bill the Member monthly in arrears for these Fees. Zoopla will report to the Member the number of unique Leads provided to the Member on a monthly basis. Any duplicated Leads or Leads from the same consumer email address or consumer telephone number in respect of the same Property shall not be counted as unique.

  10. In addition to any other termination rights, the Member’s rights to access and use the Prospect Plus (CPL) Services shall continue until the earlier of: (i) termination of the Order Form (howsoever determined); (ii) the end of the Initial Term or Renewal Term (if applicable); (iii) Zoopla discontinues the Prospect Plus (CPL) Services; or (iv) the Member breaches the terms of the Contract.

  11. Zoopla shall be under no obligation to make the Prospect Plus (CPL) Services available and Zoopla may discontinue the Prospect Plus (CPL) Services at any time without notice or liability. In addition, Zoopla may vary the Prospect Plus (CPL) Services from time to time. Any changes by Zoopla will be made in accordance with clause 2 (Contract Changes) of the Member Terms and Conditions.
